(3) The provisions of subsection (2) (c) do not apply if any scheduled substance is administeredin accordance with a written authority granted by the Minister in terms of any law; subject to such conditions as may be specified in an authority referred to in paragraph (a); and to the particular person mentioned in an authority referred to in paragraph (a). (4) The Minister may make, on the recommendation of the Council, regulations in respect of a registered person referred to in subsection (2), relating tothe investigation in respect of that person and the circumstances under which such an investigation may be conducted, including the procedures relating to such an investigation; the assessment of the condition of that person, including the procedures relating to such an assessment; the manner in which an investigation or inquiry must be conducted in order to make a finding relating to that person's competence to practise the profession in respect of which he or she is registered, including the procedures relating to such an inquiry; the conditions or restrictions which may be imposed on that person's registration or practice; the suspension or removal of that person from practising the profession in respect of which he or she is registered, and the manner in which such an order must be executed; the rescission of any condition imposed as contemplated in paragraph (d), or of an order for the suspension or removal from practising a profession as contemplated in paragraph (e); the specific acts of unprofessional conduct committed before or during an assessment, investigation or inquiry contemplated in this section; and generally all other matters which the Minister may consider necessary or expedient to be prescribed in order to achieve the purposes of this section. (5) The Council may in writing appoint a person or committee to conduct the investigation, assessment or inquiry as contemplated in paragraph (a), (b) or (c) of subsection (4), as the case may be. (4) The Council must hold not less than two meetings in each year, and may hold, in addition thereto, such other meetings as the Council may determine from time to time. (5) The majority of the members constituting the Council form a quorum for a meeting thereof. (6) (a) The Council may in terms of section 56 make rules relating to the holding of, and procedures at, meetings of the Council. (b) If the Council has not made rules referred to in paragraph (a), the president or any other person who presides at a meeting thereof must determine the procedures to be followed at the meeting over which he or she presides. (7) (a) A decision of the majority of the members of the Council present at any meeting of the Council constitutes a decision of the Council. (b) If all the members of the Council in writing under their signatures approve a written motion submitted by the registrar to all those members, then such motion so approved, notwithstanding paragraph (a) and subject to the other provisions of this section, will be regarded as a decision of the Council in terms of that paragraph. (c) The registrar must submit a written decision of the Council made in accordance with paragraph (b) to the Council at its first meeting following the making of such decision. (i) (ii) (d) A written decision made in accordance of paragraph (b) may be made at any time in between the meetings of the Council; and must form a part of the written record of the proceedings of the meeting of the Council at which such written decision was submitted to the Council in terms of paragraph (c).
